1. Scope and provider

These terms apply to the “Fermo” app (iOS) and the optional “Fermo Plus” subscription. Provider: Darius Stankevicius, Fermo Health, Brüderstraße 25, 26121 Oldenburg, Germany, [email protected]. 2. What Fermo is – and isn’t

• Fermo is a personal diary for people on GLP-1 therapy.
• Fermo is not a medical device. It does not diagnose, suggest doses, recommend changes to your treatment or assess symptoms. Drug level curves are model calculations based on published values, not measurements. Protein, water and goal values are for orientation only.
• Fermo does not replace medical advice. In an emergency call 112 (EU).
• Fermo is intended for adults (18+).

3. Free use

Core features (diary, weight, well-being, reminders, protein and water, calendar and export) are free. Features may change as we develop the app.

4. Fermo Plus (subscription)

• The price shown by the App Store in your currency before purchase applies. Prices above are German prices incl. VAT.
• Payment is charged to your Apple Account. Apple handles payment and billing.
• Trial: the paid subscription starts automatically when the free trial ends unless you cancel at least 24 hours before the trial ends. Cancelling during the trial costs nothing.
• Auto-renewal: the subscription renews automatically for the same period unless cancelled at least 24 hours before the end of the current period. Your account is charged within 24 hours before the new period starts.
• Cancellation: in your Apple Account settings (iPhone: Settings → your name → Subscriptions → Fermo Plus → Cancel Subscription). Plus stays active until the end of the paid period. Deleting the app does not cancel the subscription. See Support.
• Refunds are handled by Apple under App Store terms (reportaproblem.apple.com).
• Restore purchases on a new device with the same Apple Account via “Restore purchases” in the app.

5. Right of withdrawal

Consumers in the EU generally have a statutory right of withdrawal; for App Store purchases it is handled via Apple. TODO: withdrawal notice and model form to be drafted by a lawyer

6. Your data

Entries are stored locally on your device. You are responsible for backups, e.g. via export (JSON/CSV) or your device backup. We cannot restore local data. See the Privacy Policy.

7. Liability

We are fully liable for intent and gross negligence, injury to life, body or health and under the German Product Liability Act. For slightly negligent breach of essential contractual obligations, liability is limited to typical, foreseeable damage; otherwise liability for slight negligence is excluded. TODO: legal review

8. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection laws of your country of residence remain unaffected. We are neither willing nor obliged to participate in consumer arbitration proceedings.
